Refund & Cancellation Policy

At Immersion Displays, every LED video wall system is custom-engineered and manufactured specifically for each customer’s project. Because these products are built to order and cannot be returned to inventory, the following cancellation and refund policy applies to all purchases.

Custom Manufactured Products

All LED display panels, cabinets, mounting systems, processors, and other custom-configured equipment supplied by Immersion Displays are special-order items manufactured specifically for the customer’s project.

Cancellation Prior to Manufacturing

Orders canceled before manufacturing has begun are subject to a cancellation fee equal to 20% of the total contract value. This fee covers engineering, project management, administrative costs, supplier commitments, and production scheduling.

Any amounts paid by the customer in excess of the 20% cancellation fee will be refunded within a reasonable processing period.

Cancellation After Manufacturing Begins

Once manufacturing has commenced, the order cannot be canceled.

Because the products are custom manufactured exclusively for the customer’s project, all remaining unpaid amounts become fully due and payable in accordance with the payment schedule set forth in the purchase agreement, proposal, or invoice.

Failure to take delivery of the equipment or requesting that production stop does not relieve the customer of their contractual payment obligations.

Non-Returnable Products

Custom-manufactured LED display products are non-returnable and non-refundable once production has begun, except in the case of defects covered under the applicable product warranty.

Refunds

Refunds are available only under the following circumstances:

  • Cancellation before manufacturing begins, less the applicable 20% cancellation fee.
  • Any other refund expressly approved in writing by Immersion Displays.

Customer Acknowledgment

By approving a quotation, signing a contract, issuing a purchase order, or submitting payment, the customer acknowledges that the equipment being purchased is custom manufactured for their project and agrees to this Refund and Cancellation Policy.

Rackbuild Installation Policy

Installation Readiness and Site Conditions

Rackbuild schedules installation personnel, equipment, and travel based on the mutually agreed installation dates. It is the responsibility of the Customer, Owner, General Contractor, Construction Manager, and other trades, as applicable, to ensure the project site is ready for installation on the scheduled dates.

The installation site shall be considered “installation ready” when all conditions necessary for Rackbuild to perform its scope of work have been completed and are fully operational.

These conditions include, but are not limited to:

  • Required construction and finish work completed.
  • Safe and unrestricted access to the work area.
  • Permanent or approved temporary power available and operational.
  • Required network, data, and communication infrastructure installed, tested, and available.
  • Structural supports, blocking, backing, and mounting surfaces completed.
  • HVAC systems operational where required.
  • Lighting conditions suitable for installation and commissioning.
  • Equipment deliveries complete and available.
  • Required permits, inspections, and approvals obtained.
  • Work areas free of obstruction by other trades.
  • Environmental conditions suitable for installation and operation of equipment.

Delays Caused by Others

Rackbuild shall not be responsible for delays, increased costs, or schedule impacts resulting from acts or omissions of the Customer, Owner, General Contractor, Architect, Engineer, other contractors, suppliers, manufacturers, utilities, or any third party.

Examples include, but are not limited to:

  • Incomplete construction.
  • Missing or delayed equipment.
  • Incomplete electrical work.
  • Missing or non-functional network infrastructure.
  • Lack of internet service.
  • Ceiling, wall, or finish work not completed.
  • Inaccessible work areas.
  • Unsafe jobsite conditions.
  • Other trades occupying the work area.
  • Schedule changes made by others.
  • Inspection delays.
  • Utility outages.
  • Customer-requested postponements.

Return Visits

If Rackbuild personnel are unable to perform all or part of the scheduled installation due to site conditions, missing infrastructure, unavailable equipment, incomplete work by others, or any circumstance outside Rackbuild’s reasonable control, the scheduled installation shall be considered a completed mobilization.

Any subsequent return to the project site to complete the installation shall require an approved Change Order prior to scheduling.

The Change Order may include, as applicable:

  • Additional labor.
  • Travel expenses.
  • Lodging.
  • Per diem.
  • Equipment rentals.
  • Shipping and freight.
  • Project management.
  • Administrative coordination.
  • Remobilization costs.
  • Overtime or premium labor, if requested.

Customer Coordination

The Customer is responsible for coordinating all trades and ensuring that dependencies affecting Rackbuild’s work are completed before Rackbuild arrives on site.

Rackbuild is not responsible for managing or supervising other contractors or verifying completion of work performed by others beyond a reasonable visual inspection.

Site Access

The Customer shall provide Rackbuild personnel with uninterrupted access to the work area during scheduled installation hours.

If access is delayed, restricted, interrupted, or denied, Rackbuild reserves the right to suspend work. Time lost due to restricted access shall be billable and may require a Change Order if additional mobilization becomes necessary.

Acceptance of Installation Dates

Scheduled installation dates reserve Rackbuild personnel exclusively for the project.

Requests to postpone installation with less than five (5) business days’ notice may result in rescheduling fees, remobilization charges, and revised installation dates based on Rackbuild’s resource availability.

Force Majeure

Rackbuild shall not be liable for delays caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, labor disputes, transportation interruptions, government actions, utility failures, pandemics, civil disturbances, or other force majeure events.

Protection of Schedule

Rackbuild’s installation schedule is coordinated across multiple customer projects. Delays caused by project conditions outside Rackbuild’s control may affect future scheduling. Rackbuild will make commercially reasonable efforts to accommodate revised schedules; however, return visits will be scheduled based upon technician availability and shall not take precedence over previously committed projects.

Payment

Delays or inability to perform work due to conditions outside Rackbuild’s control shall not alter the agreed payment schedule unless otherwise stated in the contract.

Amounts due for completed project milestones remain payable in accordance with the contract terms, regardless of delays caused by others.

Reservation of Rights

Rackbuild reserves the right to suspend installation activities whenever jobsite conditions are unsafe, incomplete, or otherwise unsuitable for performing quality work. Rackbuild will resume work after all required conditions have been satisfied and any applicable Change Orders have been executed.

Applicability

This Installation Policy forms an integral part of every proposal, quotation, statement of work, purchase order accepted by Rackbuild, Master Services Agreement, and any agreement under which Rackbuild provides installation, commissioning, or related field services.

By engaging Rackbuild to perform installation services, the Customer acknowledges that it has read, understands, and agrees to be bound by this Installation Policy. In the event of a conflict between this policy and a separately executed written agreement signed by both parties, the signed agreement shall govern only to the extent of the specific conflict. All other provisions of this Installation Policy shall remain in full force and effect.

The Customer is responsible for ensuring that its representatives, agents, General Contractor, Construction Manager, Owner, consultants, and other contractors whose work affects Rackbuild’s installation activities understand and coordinate their responsibilities in accordance with this policy.
